Red $$$$$$$$$$ flags are flying at Delaware College Prep! Will Red Clay taxpayers plug the $$$ leak ?

DCPA BOARD OF DIRECTORS MEETING MINUTES DATE: Friday, January 29, 2015 TIME: 5:30PM – 6:30PM

Financial Update – budget meetings are going well between DOE and RCCD. High expenditures for legal and building expenses are driving those categories higher and we are still waiting on the remaining funds from the State. Insurance claims were filed for reimbursement of some of funds spent and additional paperwork sent. Budget will be adjust and resent to board for approval next month once monies are shifted and recoded to appropriate categories. Treasurer expressed concerns that oversight committee members are consistent no shows to meetings. But we will continue to have meetings due to state requirements. Oversight meeting will follow this meeting tonight.

Folks this does not look $$$$$$ good and look at the following state checkbook online report:

  1. What is the reason for such high legal bills for all these charters?

    • I can say McAndrews are special education attorneys. Fox Rothschild though is probably their attorney. Family Foundations Academy had very high costs with them as well. DE College Prep has over $150,000 in payments to them in seven months. That is insanely high. What Kilroy didn’t mention in the article was this:

“President also mentioned continued discrepancies with forbearance agreement and lack of communication with WF. Appears that WF weren’t informed of agreement and meetings were held to get them up to speed.” You don’t have a forbearance agreement (payment plan), unless you are already in arrears, usually by at least three months. I assume WF is Wells Fargo. A forbearance agreement is a signed document between two parties, the money lender and the party that owes the money. This is NOT a good sign Kilroy!

      As well, there is this:

“President provided announcements regarding recent events and discussions with community members. President commented on recent discussions around Advance Transportation and documents pulled to showcase challenges on bus with pupils, quality of service and parents. Information will be provided to attorneys.” Where is the transparency on these “recent events”? Did something happen on one of their buses? That could account for the very large amounts going to Fox Rothschild…

The recent legislation surrounding charter finances needs to get passed ASAP! Sounds like an FFA in the making…

Due to a frequently earned reputation across many schools, McAndrews is known and despised by myraid schools of all stripes as a hack attack firm. If you are against corporations making money off of the school system, this firm is Exhibit A at the Post Office. I’m not saying they never take on a legitimate case, but legitimacy is incidental to the reasons why they take on or pursue a case. They are about fees and profits in a zero sum win-lose world where they sucker-punch you, hold your family hostage, and then sell you “Protection”. Like most bullies, if you fight back they move on. Until GroundHog day starts over and then it is wash, rinse, repeat. They are pond scum.

Wow Publius, how do you really feel?

The Buchanan stuff looks like ordinary course legal stuff that any district or charter would incur. Buchanan is a stand-up firm

The Fox stuff looks like a potential problem based on size of payments but my guess is that is is partly a defense cost related to the McAndrews vigorish. Red Clay should inquire for understanding, as the charter authorizer.

Looks like the DCPA school could use more experienced hands at the helm. We saw what happened at Pencader when fatuous booksmart streetdumb board members lost the school and despite a comptenent takeover by Frank & Co the DOE closed them down based on “yesterday’s news”. That Pencader incompetence resurfaced on the CSD board (no surprise there). No John Young, not you — you are a special case all unto yourself.

    • An audit no matter who does it, the State Auditor or a private firm, would not stop inappropriate spending, At best it might point it out a year and a half later. The red clay office that is in charge of monitoring these charters, since they are the authorizer, should have called them on the carpet for not submitting monthly budgets, CBOc meetings, posting meeting minutes, etc. If I recall wasn’t this school also under enrolled, had extremely low academic performance, had some school leader turnover and board issues? Why hasn’t the authorizer moved toward revocation or probation? We need quality schools but we also need quality authorizer’s to hold schools accountable when they are not performing according to their charter agreement.

    • Wow, you really don’t like McAndrews? I can’t see how you would have had many dealings with them Publius. 😉
Here’s the deal though, whatever the atty fees would be to McAndrews, the atty fees to the opposing party should be MUCH less. Instead, they are over 5 times the amount. The Buchanan charges seem much more in line with a defense against McAndrews. I can understand why schools that get stuff wrong with special education wouldn’t like them. Those schools should know better!

Is this another Family Foundations Academy in the making? I agree with Kilroy, major red flags. And check out the comments I made as well!
