Section 1.  Amend § 1310, Title 14 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

(c) To the extent that the funding formula outlined in subsection (b) does not provide for 1 school nurse per facility, any school district or charter school may receive state funds for a nurse to be employed for 10 months to meet the requirement of 1 school nurse per facility.  An application process shall be established by the Department for school districts and charter schools to receive such funding. The provisions of this subsection shall be subject to the availability of funds in any fiscal year. If funding is not available for all school districts or charter schools that have applied and meet the requirements of this subsection, the Secretary of the Department of Education upon the approval of the Office of Management and Budget and the Controller General shall make a determination as to which school districts and charter schools shall receive available state funds.  Any school district that receives state funds for a school nurse pursuant to this subsection may use a match tax in accordance with §1902(b) of this title to provide for the local portion of funding needed to pay for any school nurse. All school nurses hired pursuant to this subsection shall meet the licensure and certification requirements of chapter 12 of this title.

So districts can apply to receive for a nurse? What don’t they just change the funding system altogether so every school automatically receives a nurse outside of unit count?

“If funding is not available for all school districts or charter schools that have applied and meet the requirements of this subsection, the Secretary of the Department of Education upon the approval of the Office of Management and Budget and the Controller General shall make a determination as to which school districts and charter schools shall receive available state funds.” So districts that apply, but in the past may have “offended” Murphy can be rejected funds?
